Terms of Service

These Terms of Service ("Terms") govern your access to and use of Superpower Discovery (the "Service"), operated by Superpower Discovery ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for keeping your login credentials confidential and for all activity on your account. Notify us promptly at support@superpowerdiscovery.com if you suspect unauthorized use.

2. Acceptable Use

You agree not to:

• use the Service for any unlawful, infringing, harmful, or fraudulent purpose;
• attempt to gain unauthorized access to any part of the Service or other users' data;
• reverse-engineer, scrape at scale, or interfere with the operation of the Service;
• upload content that is defamatory, obscene, hateful, or violates third-party rights;
• use the Service to build a directly competing product;
• create multiple accounts to abuse free credits, promotions, or trials.

We may suspend or terminate accounts that violate these rules, with or without notice.

3. Payment, Credits, and Refunds

Paid features are billed through Stripe. By purchasing credits or a subscription, you authorize us and Stripe to charge your payment method for the amounts shown at checkout, including any applicable taxes. Prices may change; changes will not apply to purchases already completed.

Credits are non-transferable and, unless required by law, non-refundable once consumed (that is, once a credit is used to unlock a paid phase). If you believe a charge is incorrect, contact us within 14 days of the charge at billing@superpowerdiscovery.com and we will review it in good faith.

4. AI-Generated Content

The Service uses large language models to generate business positioning, personas, offers, and related content based on the inputs you provide. AI-generated output:

• may contain errors, omissions, or statements that appear confident but are inaccurate;
• is not legal, financial, medical, or professional advice, and should be independently reviewed before you rely on it;
• may resemble content produced for other users because it is generated by shared models on shared prompts — we do not guarantee uniqueness;
• is generated at the time of your request and is not endorsed, verified, or fact-checked by us.

You are solely responsible for reviewing AI-generated output before publishing it, selling it, or making business decisions based on it.

5. Your Content and License

You retain ownership of the inputs you submit and, to the extent permitted by law, of the AI-generated outputs produced for your account ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Your Content solely for the purpose of operating and improving the Service for you. We do not use Your Content to train foundation models offered to other customers.

6. Third-Party Services

The Service relies on third parties including Supabase (data hosting and authentication), Stripe (payments), and one or more AI model providers accessed via the Lovable AI Gateway. Your use of the Service is also subject to those providers' terms and privacy practices, which we do not control.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or expense arising from Your Content, your use of AI-generated output, or your violation of these Terms.

10. Termination

You may stop using the Service at any time and request account deletion by contacting us. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (payment obligations, disclaimers, limits of liability, indemnity) will survive.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-law rules. Where local consumer-protection law grants you additional rights (including in the European Union, Spain, Indonesia, and elsewhere), those rights are not waived by these Terms.
